WAGONER, Okla. (KTUL) - A prosecutor has been fired from the Wagoner County District Attorney’s office.

Eric Jordan, assistant district attorney, is accused of driving under the influence and hitting a pedestrian before leaving the scene.

Jack Thorp, first assistant attorney for District 27 (which includes Wagoner County), said prosecutors won’t have any influence on the case as the investigation continues and possibly head to court.

“When you’re a prosecutor you have a duty to follow, you have the duty to enforce the law. And when a prosecutor commits a crime or allegedly commits a crime it doesn’t change anything that prosecutor is still going to be treated like any other person,” said Thorp.

Before posting, Thorp said Jordan was originally booked in Wagoner County Jail.

“Because of his position because of his position he probably had a hand in prosecuting several people that was out in the Wagoner County jail, he was housed in the wagoner city jail,” said Thorp.

Thorp said he doesn’t believe Jordan time in city jail was preferential treatment. He explained his office can’t prosecute him since the alleged hit and run happened in Wagoner County.

“We have an obvious conflict. This was an employee in our office, so we can’t really do anything in the case because if we did something in the case there would be the appearance of impropriety,” said Thorp.

The district attorney’s office submitted a recusal to the state. The Oklahoma Attorney General has reassigned the case to the Muskogee County District Attorney. Orvil Loge told Tulsa’s Channel 8 on the phone he is waiting for final reports from Oklahoma Highway Patrol. Loge said this will help his office decide where the prosecution will go from here. The district attorney estimated that decision could come as early as next week.
